Biography

Joining the firm in 2015 after serving as a Summer Associate, Brett Simon focuses his practice on business litigation, products liability and medical malpractice matters. He is experienced in business organization, contract claims, litigation and has also performed some appellate work.

“Joining Sandberg Phoenix was a fantastic choice since I have the opportunity to perform a wide variety of work for many different clients,” Brett says. “I’m excited to work with the attorneys here to hone my skills as a litigator.”

Brett communicates actively with clients, providing timely updates and relevant information to alleviate any worry. His primary concern is allowing clients to return to running their business or practice as he pursues their goals either through litigation or settlement proceedings.

“As an associate in a smaller office, we can provide a personal touch to matters without sacrificing the resources of a large firm, which really sets us apart,” says Brett.

Outside of his legal practice, Brett spends time with his family, including one year-old son. He also enjoys staying fit, travelling and attending events throughout the Kansas City area.

Background

While earning his bachelor’s degree, with honors, in Economics and Political Science from the University of South Dakota, Brett was the recipient of several merit-based scholarships and was a member of both the Dean’s List and the Omicron Delta Epsilon International Economics Honors Society.

Brett went on to earn his Juris Doctor from the University of Missouri – Kansas City School of Law, where he participated in the National Moot Court team and wrote for the UMKC Law Journal. He also received the CALI Excellence for the Future Award in Contracts, First Amendment Law, and Seminar on National Security Law.

During law school, Brett served at the UMKC Appellate Practice Clinic and worked as an intern at the Death Penalty Litigation Clinic. He was also a member of the UMKC Trial Advocacy Team and Moot Court Board.

He is licensed to practice law in the state of Missouri.

Successes

Western Community Insurance v. Krone, NA. Plaintiff, as subrogee, brought consumer protection act, breach of warranty, and other claims against the client in Idaho after destruction of a piece of farm machinery. The court dismissed the consumer protection act claims on the basis that an insurance company, as subrogee, did not have standing to sue under the Idaho Consumer Protection Act and dismissed a breach of warranty claim on the basis that there was no contractual privity.

Watson v. Bailey et al. In a Missouri medical malpractice case, the plaintiff voluntarily dismissed a suit, and when she re-filed, she did not serve our client with the new petition until almost two years after it had been filed. The court ruled that the due diligence rule still has some life in Missouri and dismissed all claims against the client.
