Client:

Confidential Automobile Manufacturer

Situation:

The client was presented with a breach of warranty lawsuit related to a vehicle based on the owner’s subjective complaints of excessive wind noise. Its dealers having inspected the vehicle and confirmed it met all specifications, the client took a principled approach to defend the integrity of its product. This aggressive approach was important to establish a precedent for future lemon law claims.

Solution:

We quickly evaluated the merits of the claims and defenses while also assessing the economic costs. We worked closely with the client to formulate a strategy and then implemented it through discovery and trial.

Results:

Through our partnership with the client and the assistance of the client’s representatives, who helped articulate the merits of some of our technical defenses, we were successful in obtaining a defense verdict at the conclusion of the plaintiff’s case at trial. We believe the outcome of the trial has served as a deterrent for subsequent breach of warranty claims.
