The Eastern District Court of Appeals upholding the trial court’s declaration that in any construction project a contractor/subcontractor has the right to a mechanic’s lien or claim on the surety bond, or if no surety bond is posted, then a claim against the owner for failing to have the surety bond posted.
We secured a dismissal of prevailing wage claims against its surety company client where the Court held that the claimant’s failure to abide by the 90 day notice provision and the payment bond prevented them from later claiming against the surety company for failure to pay on the bond.
