Two of the things I’m almost always asked in an initial consultation are how much a divorce will cost and how long it will take. The answer to both of those questions is: it depends. The divorce process is often determined by the willingness of the litigants to negotiate an acceptable outcome, as well as advice each party is being given by their attorney.
When both parties go into the divorce process understanding that no one will win, and no one will lose, and the possibility of punishing someone for “bad behavior” through the courts is small, it usually sets them up for being able to come to a resolution that is acceptable to all. Being acceptable to all means that neither party feels like they got everything they wanted, but they also don’t feel like they gave everything away.
If one or both parties believe they are entitled to more than the law allows, and they don’t have an attorney who will provide them with advice they need to hear, the process can be lengthy and costly. Talking to an attorney about the range of possibilities in a divorce, and understanding that what you think you deserve may not be what the law provides, can provide you with a more realistic view of the divorce process, which can help shorten the process and reduce costs.
