On April 7, 2026, Missouri Governor Mike Kehoe signed House Bill 1908 into law, introducing an important to change to Missouri family law. Beginning August 28, 2026, Missouri courts will be permitted to enter a judgment of dissolution of marriage or legal separation even if one spouse is pregnant.

Under prior law, Missouri courts were prohibited from entering a final judgment of dissolution of marriage or legal separation until the birth of child. House Bill 1908 removes this restriction. Courts will now be permitted to proceed with entry of a divorce or separation during pregnancy, while issues surrounding the unborn child- such as custody and child support- being determined after the child’s birth.
